DATI PERSONALI OGGETTO DI TRATTAMENTO
Sono oggetto di trattamento i dati personali delle persone fisiche che, in virtù del loro rapporto con aziende, enti o istituzioni scolastiche (il “Committente”), hanno ricevuto dal Committente il link per la registrazione alla WEB APP TEAM METRICS, mediante la quale la Società eroga al Committente i servizi contrattuali di Team building.
I dati trattati dalla Società sono quelli conferiti dall’utente al momento della registrazione a TEAM METRICS (nome, età, indirizzo email) e quelli raccolti nel corso dell’erogazione del servizio, che a titolo esemplificativo può comprendere: la somministrazione di questionari, la formazione di gruppi, la misurazione delle soft skill mediante griglie di auto ed etero osservazione del comportamento agito durante i laboratori o le attività di team building. L’utente potrà visionare sul proprio profilo i risultati delle attività, con indicazioni circa i propri punti di forza e debolezza; potrà realizzare un piano di sviluppo delle competenze, anche grazie alle schede di feedback che riceverà alla conclusione del percorso; con la funzione long-life learning, può visualizzare una traccia di cambiamento per ogni soft-skill distribuita nel tempo (percorso accademico o carriera in azienda).
FinalitÀ del trattamento dei DATI PERSONALI
La Società tratta i dati personali raccolti al momento dell’iscrizione nel corso dell’utilizzo della WEB APP TEAM METRICS per le seguenti finalità:
- l’erogazione dei servizi forniti al Committente mediante la WEB APP, ai sensi dell’art. 6.1 lettera b) del GDPR;
- il legittimo interesse della Società e dei suoi partner scientifici (istituti universitari ed enti di ricerca, ai sensi dell’art. 6.1 lettera f) del GDPR, consistente in:
- l’analisi, in forma aggregata dopo pseudonimizzazione, della distribuzione statistica delle soft skill, anche in riferimento a determinati parametri (es. fascia d’età, regione geografica, distanza socio-metrica dalle competenze attese) e la comunicazione dei risultati di analisi ai suddetti partner per finalità di ricerca e studio;
- la valutazione, in forma statistica, dei risultati per il miglioramento continuo delle attività e delle esperienze proposte mediante TEAM METRICS.
Obbligatorietà del conferimento dei dati
Il conferimento dei dati è obbligatorio, in quanto il loro mancato conferimento renderebbe impossibile utilizzare TEAM METRICS.
Ambito di comunicazione e diffusione dei dati personali
Se previsto contrattualmente, la Società potrà comunicare al Committente informazioni relative alla partecipazione degli utenti alle attività per finalità di rendicontazione delle attività svolte.
I dati degli utenti potranno inoltre essere comunicati alle seguenti categorie di destinatari:
- fornitori e consulenti che collaborano con la Società per lo sviluppo, la gestione e la manutenzione della WEB APP;
- gestore del servizio di hosting e delle infrastrutture di backend TEAM METRICS;
- gestore del servizio di visualizzazione dei caratteri;
- in forma aggregata, ai partner scientifici della Società.
Ove applicabile, la Società ha stipulato specifici accordi per il trattamento dei dati personali con i suddetti soggetti, ai sensi dell’articolo 28 del GDPR; l’elenco dei Responsabili del trattamento è disponibile a semplice richiesta.
Il Committente, come previsto dal contratto stipulato con Edutainment Formula, potrà visionare, per ciascun gruppo di lavoro e a livello aggregato, la polarità o l’equilibrio delle dimensioni ritenute strategiche (es: clima, produttività e processo / caratteristiche di apprendimento / competenze di cittadinanza eccetera). Non riceverà invece informazioni relative ai singoli utenti né le schede di feedback loro consegnate.
Tempi di conservazione dei suoi dati personali da parte della Società
Il suddetto periodo di conservazione è stato determinato per consentire agli utenti di non perdere traccia dei propri sviluppi e delle esperienze maturate nel caso di rinnovo del contratto con il Committente.
TRASFERIMENTO DI DATI PERSONALI FUORI DALLO SPAZIO ECONOMICO EUROPEO
I diritti DEGLI INTERESSATI
Gli utenti hanno il diritto di richiedere e di ricevere, in qualunque momento, informazioni in merito ai propri dati personali trattati dalla Società o di chiederne la rettifica. Ove applicabile, hanno il diritto di chiederne la cancellazione, di limitarne il trattamento e di ricevere, in un formato strutturato, di uso comune e leggibile da dispositivo automatico, i dati personali che li riguardano; hanno inoltre, il diritto di opporsi al trattamento dei propri dati e di proporre un reclamo all’Autorità Garante competente, ai sensi di quanto previsto rispettivamente agli articoli 21 e 77 del GDPR. Possono indirizzare ogni richiesta in merito ai propri diritti ai recapiti della Società indicati in questa informativa.

DATA SUBJECTS AND PERSONAL DATA UNDERGOING PROCESSING
Data subjects: natural person (the “User”) within the Customer organization entitled to register to the TEAM METRICS WEB APP (hereinafter also the “APP”) by means of the specific link provided to him/her by the Customer itself (“Customer” means a Company, a Body or an educational institution to which EDUTAINMENT is providing a contractual service of Team building via the aforesaid APP).
Data undergoing processing: personal data provided by the User in order to access the APP (first name, age, email address) and collected by EDUTAIIMENT throughout the delivery of contractual services, that, exemplifying, may include: surveys; group assignment; soft skill evaluation against a specific pre-established competence through hetero-observation or self-observation grids of the behaviour acted during a workshop or a team building group activity. The User will be able to view the results of the activities on his/her own-profile, with indications about his/her strengths and weaknesses; will be able to implement a skills development plan, also thanks to the feedback sheets received at the end of the experience. With the long-life learning function, the User can view a change track for each soft-skill distributed over time (academic path or career in the company).
PURPOSE AND LAWFULNESS OF PROCESSING
EDUTAIMENT will process the User’s personal data for:
- the performance of a contract to which the data subject is party, as per art. 6 Para. 1 Letter b) GDPR;
- the legitimate interest of EDUTAIMENT and its partners (University and Research Group and institution), as per Art. 6 Para. 1 Letter f) GDPR, consisting in:
- the analysis, in aggregate form after pseudonymization, of the statistical distribution of the soft skills, also in reference to certain parameters (e.g. age group, geographical region, socio-metric distance from expected skills) and the communication of analysis results to the aforementioned partners for research and study purposes;
- the statistical evaluation of the analysis results for the continuous improvement of the activities and the experiences proposed to the User through the APP.
Consequences of the failure to provide personal data
The User is obliged to provide his/her personal data: the consequence in failure to provide such data would make it impossible to use the APP.
CATEGORIES OF RECIPIENTS OF THE PERSONAL DATA
Where stated in the agreement with the Customer, EDUTAIMENT can communicate to the Customer the status report referred to the participation of User to the activities.
Additionally, the personal data of the User shall be communicated by EDUTAIMENT to the following categories of recipients:
- suppliers and independent contactors who collaborate with EDUTAINMENT for the development, management and maintenance of the APP;
- provider of the TEAM METRICS hosting and backend infrastructure services;
- provider of the typeface visualization service;
- scientific partners of EDUTAINMENT, in aggregate form.
Where applicable, EDUTAIMENT stipulated specific Data Process Agreement with the previous mentioned recipients as per art. 28 GDPR; the list of data processors is available upon request.
The Customer, as stated in the agreement with EDUTAINMENT, will be able to view the polarity or balance of the dimensions considered strategic (eg: climate, productivity and process / learning characteristics / citizenship skills, etc.) for each working group and at an aggregate level. It will not receive information about the single User or the feedback report cards given to them by EDUTAIMENT.
DATA RETENTION PERIOD
The user’s registration data, any measurements made during the activities and the feedback report cards will be stored within the APP for a period of 24 months, calculated from the termination of the contractual services provided to the Customer.
The aforementioned retention period has been determined to allow user not to lose track of his/her developments and of the experiences gained, in the event of further renewal of the agreement with the Customer.
TRANSFERS OF PERSONAL DATA TO THIRD COUNTRIES
The user’s data could be transferred to countries outside the EU, in particular to the USA, where the providers of typeface visualization services and of the hosting and backend infrastructure services are established. The transfer is based on the adequacy decision by the European Commission (2023, Luly 10th) as the providers are in the Data Privacy Framework List set forth by the U.S. Department of Commerce.
DATA SUBJECT RIGHTS
The data subjects have the right to request and receive, at any time, information on their personal data being processed by EDUTAINMENT and to request their rectification.
Where applicable, they also have the right to request the erasure or the restriction of processing of their personal data, and to receive their personal data in a structured, commonly used and machine-readable format; moreover, they have the right to object to their processing at any time or to lodge a complaint with the competent supervisory authority, pursuant the provisions respectively of art. 21 and art. 77 GDPR.
